The order denying the Commonwealth’s motion for summary judgment is reversed, and a final judgment is to be entered under Mass.R.Civ.P. 54(b), 365 Mass. 821 (1974), which dismisses the action as to that defendant. The report is dismissed in so far as it purports to present a question with respect to any of the other motions for summary judgment.
