SCHOOL COMMITTEE OF QUINCY vs. MAYOR OF QUINCY.

Appeals Court of Massachusetts.
February 3, 1983.

The judgment entered on January 12, 1982, is reversed and a new judgment is to enter stating that “The matter having been heard fully, it is hereby adjudged and declared that the defendant as mayor of the city of Quincy is not required to include in the annual city budget a recommendation for the support of the public schools in the amount requested by the school committee. As mayor he has the authority to reduce the budget submitted to him by the school committee and need not submit that budget to the city council either when received by him separately or as part of the annual total city budget.”
