MARYANN PALKO, executrix, vs. DENNIS PANNULLO another.

No. 96-P-1424.Appeals Court of Massachusetts.
April 1, 1997.

The judgment of dismissal which entered on February 23, 1996, and the judgment of dismissal which entered on March 22, 1996, are vacated. The matter is remanded to the Superior Court where the findings of the medical malpractice tribunal are to be replaced by the decision of the Appeals Court that the offer of proof of the plaintiff, if properly substantiated, is sufficient to raise a legitimate question of liability appropriate for judicial inquiry. The plaintiff may proceed with her claim.
