Decision Pursuant to Rule 1:28.

The rule 54(b) judgment entered August 14, 2002, shall be modified to specify that counts I and II of Garrity’s counterclaim are dismissed and to require that Garrity return the vehicle to the plaintiff upon satisfaction of judgment. As so modified, the judgment is affirmed. The rule 54(b) judgment of dismissal entered December 5, 2002, shall be modified to dismiss the plaintiff’s complaint as to all defendants and, as so modified, is affirmed.
