The judgment on no. 92-0008B is reversed and the verdict is set aside. The matter is remanded to the Superior Court, where a directed verdict of not guilty is to enter on so much of the indictment (no. 92-0008B) as charged Reyes with intent to distribute heroin. Judgment is to enter and Reyes is to be resentenced on the lesser offense of simple possession of heroin (G.L.c. 94C, § 34).
