The order denying the defendant’s motion to vacate the conviction and dismiss the indictment is affirmed. The order denying the motion for a new trial is vacated, and the matter is remanded to the Superior Court for consideration of the defendant’s motion for discovery and, after an opportunity for any reasonable discovery, for an evidentiary hearing on the motion for a new trial and the making of findings of fact pursuant to Rule 30(b).
