COMMONWEALTH vs. MICHELLE GIRARD.

No. 01-P-667.Appeals Court of Massachusetts.
December 17, 2002.

We affirm so much of the judgment as constitutes the offense of operating a motor vehicle while under the influence of alcohol and reverse so much of the judgment, and set aside so much of the verdict, as constitutes a conviction of the offense as a fifth offense and remand the case to the District Court for resentencing.
