We affirm the dismissal of the plaintiff’s APA counts (Counts I and II), and we reverse the dismissal of the plaintiff’s FIPA count (Count III). The matter is remanded to the Superior Court for further proceedings consistent with the memorandum and order on file in the Appeals Court.
