The judgment of dismissal in Norfolk case no. 122213 entered on July 9, 1986, is vacated, and count 4 of the amended complaint filed November 1, 1977, is reinstated for further proceedings consistent with the order on file and, as to that count, with the order of January 6, 1984, of the Superior Court. The judgment of dismissal in Suffolk case no. 23691 entered on July 9, 1986, is vacated, and counts 3 and 4 of the amended complaint filed October 14, 1977, are reinstated for further proceedings consistent with the order on file and with the order of January 11, 1984, of the Superior Court.
