93 LIQUORS, INC. vs. INTERNATIONAL SPIRITS, INC., ANOTHER.

March 29, 1996.

The judgment on the counterclaim is reversed, and judgment shall enter for the plaintiff on the defendant’s counterclaim. A new judgment shall enter on count I of the complaint declaring that the plaintiff’s obligations to the corporation under the primary lease, if any, and under the improvements lease, terminated on November 30, 1989, and neither the corporation nor the defendant Donald M. Manzelli has any further claims against the plaintiff by reason of those instruments. Count II of the complaint is to be dismissed. There is no evidence to support a finding for the plaintiff under c. 93A.
